Who are we?

Citizen Ticket Ltd is a company incorporated in Scotland (company number: SC454982) with the registered office at 63 Dublin Street, Edinburgh, EH3 6NS, trading as citizenticket.co.uk ("Citizen Ticket").

In most cases Citizen Ticket acts as an agent selling tickets on behalf of third party event providers ("Organisers"). In the event that Citizen Ticket is selling tickets for its own events, all references to an Organiser in these terms and conditions of purchase (“Terms”) will refer to Citizen Ticket.

Capitalised but undefined terms used in this clause 1 shall have the meaning given to them in clause 2.

Purpose of these Terms
-
These Terms govern both the use of the Citizen Ticket website and Citizen Ticket - Ticket Wallet mobile application (collectively, "Platform") and apply to the application, purchase and use of Tickets.

By using or visiting the Platform, you expressly agree to be bound by these Terms and all Applicable Laws. Any person who applies for, purchases, possesses or attempts to use a Ticket shall be deemed to have accepted and agreed to comply with these Terms, the applicable Organiser Terms and the Applicable Laws.

Changes to these Terms
-
Citizen Ticket reserves the right to change these Terms at any time if reasonably necessary, effective immediately upon posting on the Platform. Any amendment to these Terms shall not apply to any orders for which Citizen Ticket has already received payment.

Where you have provided Citizen Ticket with an email address during the purchase of any tickets, Citizen Ticket will notify you of any material changes to these Terms by sending a copy to the email address you provided when purchased tickets on the Platform. The new Terms will also be posted to the Platform.

Your use of the Platform and any purchases you make from the Platform will be subject to the most current version of these Terms at the time of such use or purchase.

Violation of these Terms
-
If you violate these Terms, Citizen Ticket may terminate your use of the Platform, bar you from future use of the Platform, cancel your order and/or take appropriate legal action against you.

Any breach of these Terms, any Organiser Terms and/or any Applicable Laws shall entitle Citizen Ticket to cancel and invalidate the Ticket and any other Tickets that have been purchased by you with no right to a refund.

Your attention is particularly drawn to clauses 4.10 (Refunds and Cancellation Policy), 4.11 (Liability) and 4.12 (Force Majeure).

Definitions and interpretation

Definitions
-
“Applicable Laws”: means all laws, statutes, common law, regulations, ordinances, codes, rules, guidelines, orders, permits, tariffs and approvals, including those relating to the environment, health and safety or sanitary measures in the context of COVID-19, of any governmental authority that apply to you and/or Guest, or the subject matter of these Terms.

“Conditions of Entry”: any terms and conditions applicable to the Event and/or Venue for which the Tickets have been purchased.
-
“Cookies Policy”: Citizen Ticket’s cookies policy.
-
“Event”: the event to which the Ticket relates.
-
“Excluded Person”: any person: (a) refused entry to the Event (or any other event sanctioned by the Organiser or the national governing body of the Organiser; (b) ejected from the Venue (or the grounds of any other Organiser sanctioned event); (c) banned by an applicable governing body in any jurisdiction in the World; (d) subject to a ban issued by Citizen Ticket; (e) who has acted in breach of these Terms, any Additional Terms or any terms imposed by an Authorised Agent from time to time.

“Force Majeure Event”: any circumstance not within Citizen Ticket’s or the Organiser’s reasonable control including: (a) acts of God, abnormally inclement weather, flood, drought, lightning, storm, earthquake or other natural disaster; (b) epidemic, pandemic or infectious disease; (c) terrorist attack, civil war, civil commotion or riots, crowd disorder, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government, public authority, court, competent national authority or governing body, including cancelling a public event, imposing capacity restrictions on a public event, imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent; (f) collapse of buildings, subsidence, structural damage, fire, explosion or accident; (g) player strike; (h) death of a member of the royal family; and (h) any labour or trade dispute, strikes, industrial action or lockouts.

“Guest”: any individual that accompanies you, to whom Tickets may be transferred in accordance with these Terms and the Organiser Terms.

“Organiser Terms”: any additional terms that apply to Tickets, as specified by the Organiser from time to time.
-
“Privacy Policy”: Citizen Ticket’s privacy policy.
-
“Purchase Notification”: the notification (in writing or orally in person or over-the-phone) confirming the allocation of Ticket(s) to you, as sent by Citizen Ticket (which may include, if applicable, updating the applicant’s status on the Platform).
-
“Purchase Price”: the total purchase price for the Ticket(s) as notified by Citizen Ticket from time to time (including, if applicable, on the Platform), inclusive of the shipping/delivery fee (if applicable), booking fee, administrative costs and all relevant taxes.

“Terms of Use”: Citizen Ticket’s terms of use relating to the Platform .

“Ticket(s)”: the electronic/mobile (or, in limited cases, paper) ticket provided by Citizen Ticket to you (subject to these Terms) which grants you the right to attend the Venue.

“Venue”: the venue of the Event.

Interpretation
-
Unless the context otherwise requires, words in the singular shall include the plural and words in the plural shall include the singular.
-
A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision.
-
Any obligation on a person not to do something includes an obligation not to allow that thing to be done.
-
Any reference to an English legal term for any action, remedy, method of judicial proceeding, legal document, legal status, court, official or any legal concept or thing shall, in respect of any jurisdiction other than England, be deemed to include a reference to that which most nearly approximates to the English legal term in that jurisdiction.

References to clauses are to the clauses of these Terms.

Any words following the terms “including”, “include”, “in particular”, “for example” or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.

CITIZEN TICKET PURCHASE POLICY
-
Your status
-
In order to place an order through the Platform (for which you must have an account registered with Citizen Ticket), you warrant, represent and confirm that:
-
you are at least 16 years old;
-
you have capacity to enter into a contract for the purchase of Tickets;
-
you are ordering through the Platform as a personal user and not for commercial or business purposes;
-
any Tickets you purchase are intended for domestic, private and non-commercial use and by making a Ticket purchase through the Platform and accepting these Terms, you represent to Citizen Ticket that you are acting as a consumer and not for purposes relating to your trade, business, craft or profession;
-
you agree to be bound by these Terms and any applicable Organiser Terms and Organiser privacy policy;
-
you are not an Excluded Person. Excluded Persons shall not be permitted to make any application for Tickets and any Ticket(s) acquired or used in breach of this clause 4.1.1(f) shall be void with no right to a refund and all rights conferred or evidenced by such Ticket shall be nullified;
-
you have not exceeded the Ticket purchase limits with respect to the particular Event set from time to time by Citizen Ticket and/or the applicable Organiser. Any Ticket(s) acquired or used in breach of this clause 4.1.1(g) shall be void with no right to a refund and all rights conferred or evidenced by such Ticket shall be nullified; and
-
all information provided by you during the application process for any Ticket is true and accurate (including with respect to your guests, if applicable). If you are subsequently found to be in breach of this clause 4.1.1(h), Citizen Ticket shall be entitled to refuse your application or void their Ticket(s) (if it has/they have been issued).

How the contract is formed between you and the Organiser
-
The listing of Tickets on the Platform does not constitute an offer by Citizen Ticket or the Organiser. You will notify the Organiser and Citizen Ticket with an offer that you are willing to purchase the selected Tickets from the Organiser for the Purchase Price by completing and submitting an application on the Platform. The sales contract between the Organiser and you for the purchase of Tickets will be concluded and confirmed (under these Terms) only after the:
-
successful credit or debit card verification (if applicable), other security checks, blockchain verification, processing of the credit or debit card payment or bank payment for the Ticket(s) and collection of payment by Citizen Ticket (or our third party payment providers or payment initiation service providers, such as Opayo (formerly Sage Pay) and TrueLayer, respectively) in accordance with clause 4.4. Your order may be cancelled if it has not passed any relevant verification process or if payment, including any applicable fees, is not received in full; and
-
acceptance of your offer by Citizen Ticket by way of submission of the Purchase Notification to you.

Any applicant who, in the reasonable opinion of Citizen Ticket, applies for and/or purchases Ticket(s) using any computer software which is designed to afford an applicant an increased chance of being successful in the purchase of Tickets (such as robot, spider or other automated device or software), shall have any application rejected and/or any Tickets purchased by them cancelled in full, regardless of whether such applicant has been successful in their application. It is prohibited to obtain or attempt to obtain any tickets through unauthorised use of any illegal or unauthorised activity including but not limited to chargebacks.

Citizen Ticket reserves the right to cancel any order(s) for Tickets that Citizen Ticket reasonably suspects to have been made fraudulently or otherwise in breach of these Terms. Cancellation may be without notice to you. Any and all Tickets(s) obtained as part of any such cancelled order(s) will be void.

In an application for Ticket(s), you are required to provide all information reasonably required by Citizen Ticket and the applicable Organiser from time to time, which may include your surname, first name, date of birth, postal address and phone number. You accept and acknowledge that this information is required for purposes including the facilitation of a Ticket application, identification, health and safety and enforcement of these Terms. For more information on how your personal data will be processed, please see the Privacy Policy and any privacy policy of the applicable Organiser.

It is your sole responsibility to ensure that:
-
an application for Ticket(s) has been filled-in completely and accurately with all required personal details and payment information and properly submitted to Citizen Ticket in accordance with the instructions specified by Citizen Ticket from time to time (including, if applicable, on the Platform);
-
acceptance of these Terms and the applicable Organiser Terms as required by Citizen Ticket in the application process is properly given (including by clicking the respective box(es) on the Platform, if applicable);
-
you and your Guest(s) (if applicable) understand how their personal data will be processed as detailed in the Privacy Policy and the Organiser’s privacy policy. By submitting an application personally and on behalf of each Guest, you accept and acknowledge the foregoing (and confirm that each Guest accepts and acknowledges the foregoing). In particular, you acknowledge (regardless of whether you are allocated any Tickets) that Citizen Ticket may use any information provided during your application for the purpose of processing such application and for Citizen Ticket’s enforcement of its legal rights; and
-
sufficient funds to cover the Purchase Price for the Ticket(s) (and any credit or debit card issuing bank fees) are available on the credit or debit card or payment account indicated for payment at the point of payment, and any failure by you to comply with the requirements detailed in this clause 4.2.5 will result in the application (and thus your offer to purchase Ticket(s)) being rejected).

To prevent fraud, enforce these Terms and protect Citizen Ticket and its Organisers, Citizen Ticket reserves the right to carry out checks and/or request that additional information be provided in order to verify purchases. In accordance with clause 4.2.3, Citizen Ticket may cancel orders which Citizen Ticket reasonably suspects to have been made fraudulently or in breach of these Terms.

Citizen Ticket’s status
-
Please note that Citizen Ticket enables purchases of Tickets as a limited service provider and sales agent on behalf of third party Organisers, solely providing services that facilitate sales contracts directly between the Organisers and you for sales of Tickets via the Platform. The resulting sales contract is between you and that Organiser, and is subject to the Organiser Terms, which are displayed on the applicable Event page. You should carefully review the Organiser Terms applying to the Event.

The Platform facilitates the sale of Tickets by an Organiser to you. We do not give any undertaking that the Tickets that you purchase from third party Organisers through the Platform will be of satisfactory quality, and any such warranties are disclaimed by Citizen Ticket absolutely. This disclaimer does not affect your statutory rights against the third party Organiser. If you would like information about your legal rights, you should contact your local Trading Standards service or Citizens Advice Bureau.

The enforcement of any contractual obligations arising out of the completion of sales contract using the Platform is the responsibility of you and the specific Organiser that is party to that sales contract. Citizen Ticket is not obliged to mediate between you and Organisers or enforce or execute fulfilment of any sales contract. You use the Platform at your own risk. You will resolve any subsequent dispute directly with the Organiser.

The Ticket prices quoted on the Platform (usually displayed in a blue font colour on the relevant Event page) are inclusive of VAT, and are broken down as follows:
-
the face value of the Ticket (the “Face Value”); and
-
the booking fee charged for the Ticket (the “Booking Fee”).
-

Whilst Citizen Ticket tries to ensure that all listings for Tickets and advertised prices on the Platform are accurate, errors may occur. If Citizen Ticket discovers an error in the price of any Ticket that you have purchased which has resulted in an incorrectly confirmed order for Tickets, Citizen Ticket will inform you as soon as possible and reserves the right to cancel the purchase. Where possible, Citizen Ticket will give you the option of:
-
confirming your order at the correct price (in which case Citizen Ticket will credit or debit the card or payment account you used to make the initial purchase as applicable); or
-
cancelling your order (in which case you will receive a full refund).
If Citizen Ticket is unable to contact you, on the contact details you provided when placing your order, to confirm your order at the correct price, you agree that Citizen Ticket may treat the order as cancelled and issue you with a full refund without any further liability to Citizen Ticket.
For the avoidance of doubt, where payment for Ticket(s) is made via TrueLayer, Citizen Ticket will request bank details from you via email, and proceed according to clause 4.4.2(a) or clause 4.4.2(b) as applicable via a bank-to-bank transfer.

You acknowledge that by making an application (including, if applicable, by clicking the confirmation button/field on the Platform), you agree to make payment of the relevant Purchase Price, provided the requested Ticket(s) are allocated by Citizen Ticket to you.

Citizen Ticket uses Opayo (formerly Sage Pay) to collect and process credit card and debit card transaction information, and their security policy can be found here. Citizen Ticket also works with TrueLayer to enable open banking payments. TrueLayer (firm reference number 901096) is regulated and authorised by the UK Financial Conduct Authority to issue electronic money and provide payment services. To make payment via TrueLayer, you must provide them with express consent. Please see their end-user terms of service for more information. Details on TrueLayer’s security measures can also be found here.

Payment for Ticket(s) purchased on the Platform may be by debit or credit card as fulfilled by Opayo (formerly Sage Pay), or by bank-to-bank transfer via TrueLayer.
-
Your bank or credit or debit card issuer will apply its own currency exchange rates (if applicable) and may levy additional fees or charges for such transaction. You should contact your bank or credit or debit card issuer before submitting the application in order to enquire about the relevant exchange rates, charges or fees. Citizen Ticket shall not be responsible for any such exchange rates, fees or charges levied by your bank or credit or debit card issuer.

You acknowledge and agree that all Ticket purchases are final and that (save for circumstances where the provisions of clause 4.10 apply) no cancellations will be permitted nor will refunds or exchanges be given following the submission of an application and successful processing of your credit or debit card payment or open banking payment.

You are requested to review your Purchase Notification for any inaccuracies. Any inaccuracies shall be immediately notified to Citizen Ticket via the Platform or in accordance with clause 4.14.1.

Tickets
-
Any Tickets purchased will be at your risk from the time of deemed receipt of the Purchase Notification as set out in clause 4.2.1(b).
-
Any Ticket you purchase from Citizen Ticket remains the property of the relevant Organiser at all times and is a personal revocable licence which may be withdrawn and admission may be refused at any time. If this occurs, refunds will only be issued according to the provisions set out at clause 4.10.
-
It is your responsibility to check your Tickets prior to purchase and once they have been delivered; mistakes cannot always be rectified.
-
Where your Tickets are for allocated seats, you have the right only to seats of a value corresponding to that stated on the Ticket. Citizen Ticket (on behalf of the relevant Organiser) reserves the right (whether before or during the Event) to provide alternative seats to those initially allocated to you or specified on the Tickets.

Availability and Delivery
-
Tickets will usually be issued in the form of eTickets containing a QR Code that may be scanned for entry at the Event.
-
For the avoidance of doubt, you will not receive a refund for any Ticket(s) which you fail to download.
-
Defective mobile Ticket(s), such as Tickets not being displayed due to defective mobile phone or insufficient battery, or incorrect personal information displayed on the Ticket, will be rejected at the entrance to the Venue. Neither Citizen Ticket nor the applicable Organiser shall be responsible for defective, lost or stolen Ticket(s) and will accept no obligation to reissue any such Ticket(s), provided that where there is a defect of a mobile Ticket entirely attributable to Citizen Ticket, Citizen Ticket shall where reasonably possible block the Ticket concerned after notification of the defect and issue a new Ticket to you upon provision of sufficient evidence from you.

Permitted Ticket holders
-
You are permitted to attend the Event provided that:
-
you are not an Excluded Person;
-
the Ticket has been obtained in accordance with these Terms;
-
you comply with any and all entry requirements and/or acknowledgements (including any epidemiological acknowledgements, if required) in the context of COVID-19, as notified to you by Citizen Ticket and the Organiser; and
-
where you travel to the United Kingdom, you have complied with any requirements which are in place regarding entry into the United Kingdom (including obtaining a valid VISA (if required) and any travel and entry requirements imposed under Applicable Laws and/or otherwise in the context of COVID-19).

For the avoidance of doubt, Citizen Ticket shall not be liable for any loss or damage suffered by you should you fail to comply with the provisions of clause 4.7.1 and/or, where required, fail to obtain the necessary documents.

Except as expressly permitted in the Organiser Terms, any resale, transfer of Ticket(s), offer or advertisement of Ticket(s) for resale or transfer, whether for free or for consideration, is strictly prohibited. This prohibition extends to:
-
the resale or transfer;
-
advertising for sale or transfer; and/or
-
providing access to the,
(i) mobile (or other) device upon which a Ticket is held/displayed; or (ii) the Platform profile/account within which a Ticket(s) can be accessed, for the purpose of reselling/transferring Ticket(s).

Except as expressly permitted in the Organiser Terms, the Ticket(s) shall not be:
-
used for any promotion, advertising, fundraising, auction, raffle or any other similar commercial or non-commercial purposes;
-
used as a prize (or part of a prize) in any contest, competition, (promotional) game of chance, lottery or sweepstake;
-
combined with and sold or transferred as part of any package of goods or services; or
-
combined with and sold as part of any travel or hospitality package (for example combining flights, hotels and the Ticket(s)).

You assume full and absolute responsibility for all Tickets allocated to you, including for a breach of any other provision of these Terms, whether or not such advertisement, offer for sale or transfer and/or sale or transfer (or other breach of these Terms) takes place with your knowledge.
-
Any Ticket(s) acquired or used in breach of this clause 4.8 shall be void with no right to a refund and all rights conferred or evidenced by such Ticket shall be nullified. Any person seeking to use such Ticket(s) will be deemed a trespasser and may be refused entry or be evicted from the Venue and may be liable to further legal action. Any unauthorised sale or transfer of the Ticket(s) may be reported to the police.

Entrance to the Venue shall be subject to compliance with:
-
the applicable Conditions of Entry;
-
all Applicable Laws governing access or presence at the Venue, use of the Tickets, general safety certificate and any special safety certificate applying to the Venue, issued by any authority that has jurisdiction or authority in relation to the holding of the Event at the Venue; and
-
the requirement of presentation of:
-
the Ticket; and
-
proof of identity with any photographic evidence requested by the Organiser.

It is your responsibility to ensure that the Tickets are displayed correctly either on your mobile phone (for example, via the Citizen Ticket - Ticket Wallet mobile application) or on paper. Your entrance to the Venue depends on the satisfactory production of the relevant ticket wallet QR code or evidence of identity linked to the relevant Ticket, but shall at all times be at the Organiser’s discretion. You must retain your Ticket (e.g. your mobile phone which displays the Ticket, if applicable) at all times. Failure to do so may result in your being evicted from Venue without refund or compensation.

Refunds and Cancellation Policy
-
No refunds will be given in accordance with this clause 4.10 where there has been a breach of these Terms by you.
-
Citizen Ticket reserves the right to cancel any Ticket at any time for any operational reasons (Citizen Ticket acting reasonably in determining this) or as a result of any Force Majeure Event and in the event that Citizen Ticket exercises this right, Citizen Ticket shall refund the Purchase Price without further liability, including for indirect or consequential loss, loss of enjoyment, loss of a chance, loss of time, or travel costs or accommodation costs.

Tickets cannot be transferred, exchanged or refunded once purchased other than for the reasons set out in these Terms.
Tickets purchased for third party Events
-
For tickets purchased when Citizen Ticket acts as agent for third party Organisers:
-
Customers are referred to the refunds and cancellation policy as set out in the Organiser Terms.
-
Citizen Ticket operates a specialised refund resolution service on the Platform to facilitate the refund process between third party Organisers and customers in the first instance. To apply for a refund, please go to the official Citizen Ticket website and sign into your account. Please then select “Request a refund” at the footer of the website. Information on the refund application will be displayed on the relevant webpage, which you are encouraged to read before submitting a refund application. For the avoidance of doubt, the decision to approve or decline a refund lies with the relevant third party Organiser, as Citizen Ticket merely acts as the agent selling Tickets on behalf of third party Organisers. Any refund decision will be communicated to the customer via email. If a customer disputes the Organiser's decision to not issue a refund or the amount of a refund, the customer may submit a complaint to Citizen Ticket, who will contact the Organiser and help facilitate a resolution. Citizen Ticket endeavours to resolve such complaints within 30 days from the date of submission, but depending on the circumstances, this may take longer. Citizen Ticket expects both the Organiser and customer to act in good faith, and to respond or otherwise cooperate within a reasonable amount of time. If the Organiser decides to cancel or postpone an Event prior to the Event date, upon receiving the written authorisation of the Organiser, Citizen Ticket will process customers' refunds within 14 days of receiving the instructions from the Organiser to do so. If Citizen Ticket has not been at fault, refunds may exclude the Booking Fee (i.e. only the Face Value refunded).

All refunds are at the discretion of the third-party Organiser. It is the Organisers option to process 'full refunds', including booking fees, or ‘partial refunds’, excluding booking fees. In the case that Citizen Ticket have made an error full refund including booking fees will be returned to the customer.
Tickets purchased for Citizen Ticket Events

For tickets purchased where Citizen Ticket is the Organiser:
-
If an Event is cancelled, Ticket holders will be offered tickets at any rescheduled event (subject to availability) up to the Face Value of the Tickets purchased. If the Ticket holder is unable to attend the rescheduled event or the Event is not rescheduled, the Ticket holder will be entitled to a refund if the Ticket holder notifies Citizen Ticket in writing as per clause 4.10.5(d).

If an Event for which you have purchased Tickets is "materially altered" as defined below, other than a rescheduling, you may choose to cancel your order by notifying Citizen Ticket in writing as per clause 4.10.5d). Failure to inform Citizen Ticket in writing within the deadline specified by Citizen Ticket that you wish to cancel your order will be deemed to be a reconfirmation of your order for the Tickets for the altered event, and you will not be entitled to a refund.

For the purposes of these Terms, a “material alteration” is a change which in Citizen Ticket's reasonable opinion, makes the event materially different to the Event that purchasers of the Tickets, taken generally, could reasonably expect. In particular, the following are not deemed to be material alterations:
-
The use of understudies in theatre performances;
-
Adverse weather conditions;
-
Changes of any supporting act;
-
Changes to the Event location where this is within the reasonable vicinity of the initial location;
-
Changes to individual members of a band;
-
Changes to the line-up of any multi-performer Event (e.g. a festival);
-
Curtailment of the Event where the majority of an event is performed in full; and
-
Delays to the start of an Event.
-

All requests for refunds must be made via the Platform or at info@citizenticket.co.uk no later than 7 days after the date of the cancelled Event or the date the Ticket holder was notified that the Event was to be rescheduled or materially altered.
-

In the event a refund is being issued due to an error by or a fault on the part of Citizen Ticket or due to the cancellation of the Event for which Tickets have been purchased, the refund amount will normally be a sum equal to the Purchase Price. If a refund is being issued for any other reason, the refund amount will be a sum equal to the Face Value of the Ticket(s) purchased (i.e. the Booking Fee(s) will be non-refundable).

Refunds will only be issued to the original purchaser and to the original payment method.

Citizen Ticket shall not be liable for any refund, loss (including indirect or consequential loss), damage or expense caused by a Force Majeure Event.
-
Subject to clause 4.11.5, in the event that Citizen Ticket is in breach of its obligations (under these Terms or otherwise), Citizen Ticket shall only be responsible for such loss or damage suffered by you which was reasonably foreseeable as a result of the breach. Citizen Ticket shall not be responsible for any loss or damage that is not reasonably foreseeable or contemplated at the time you entered into a contract pursuant to these Terms.

Subject to clause 4.11.5, Citizen Ticket is not liable for any business losses and Citizen Ticket will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Subject to clause 4.11.5, in any event, to the maximum extent permitted by law, Citizen Ticket hereby excludes any liability for loss, damage or injury to you and/or your property, including any indirect or consequential loss or damage, including loss of enjoyment or travel or accommodation costs, regardless of whether the loss or damage: (a) would arise in the ordinary course of events; (b) is reasonably foreseeable; or (c) is in the contemplation of the parties, or otherwise.

Notwithstanding any provision in these Terms, Citizen Ticket does not seek to exclude or limit its liability: (a) for fraud or fraudulent misrepresentation; (b) for death or personal injury caused by Citizen Ticket’s negligence or the negligence of any of its officers, employees or agents; or (c) for any other matter for which it is not possible to exclude or limit liability by Applicable Laws (including your statutory rights and rights as a consumer).

Citizen Ticket’s total aggregate liability to you in respect of any loss or damage suffered and arising out of or in connection with these Terms, whether in contract, tort (including negligence) or otherwise shall not exceed a sum equal to the Purchase Price.

Citizen Ticket and the Organiser reserve the right to make alterations to the time, date and location of the Event due to any Force Majeure Event which has a major impact on the Event and/or Venue.

Severability

Should any provisions of these Terms be declared void, ineffective, illegal or unenforceable by any competent court, regulator or authority, the remainder of these Terms shall remain in effect as if such void, ineffective, illegal or unenforceable provision(s) had not been included.

These Terms have been drafted in the English language and may be translated into other languages and are available on the Platform. In the event of any discrepancy between the English and any translated version, the English version shall prevail.

You consent to these Terms yourself and on behalf of your Guest(s) (i.e. you shall ensure that your Guest(s) understand(s), agree(s) with and will conform to these Terms). If the Guest is under the age of 18 you confirm that you have received proper consent to these Terms from the Guest(s)’s appropriate parent or guardian under the Applicable Laws.

These Terms (together with the applicable Organiser Terms and Conditions of Entry) constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Terms which is not already set out in these Terms.

Any person not a party to these Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 with the exception of any company within Citizen Ticket’s group of companies.

These Terms are governed by the laws of England and Wales. The parties agree that the courts of London, England have exclusive jurisdiction to settle any dispute arising under or in connection with these Terms. Notwithstanding the foregoing: (a) these Terms shall not affect a person’s statutory rights as a consumer and, in particular, if the claimant lives in Scotland they can bring legal proceedings in either the Scottish or the English courts, or if they live in Northern Ireland, they can bring legal proceedings in either the Northern Irish or the English courts; and (b) Citizen Ticket reserves the right to pursue legal proceedings in a competent court of your domicile, where such proceedings shall be governed and interpreted in accordance with English law.
